the RTI The three-member panel comprising a retired chief justice of India and two retired supreme court judges was appointed last year by the apex court to make recommendations about the restructuring of the Board in the wake of a series of scandals that brought the cricketing body under the judicial scanner Among the many sweeping recommendations that Justice Lodha committee has made earlier this week is its forceful plea to bring the BCCI under the Right to Information (RTI) Act PTI Among the many sweeping recommendations that Justice Lodha committee has made earlier this week is its forceful plea to bring the BCCI under the Right to Information (RTI) Act — “The committee feels that since the BCCI performs public functions people have the right to know activities of the BCCI Whether RTI Act is applicable to the BCCI or BCCI is amenable to RTI is sub-judice We have recommended the legislature must seriously consider bringing BCCI within the purview of the RTI Act” Over the years since the RTI Act came into effect in 2005 BCCI has strongly resisted the proposition to bring it within the ambit of the RTI Act Its main contention has been two fold – that it is a Society registered in Tamil Nadu and that it does not receive government funds So it should be treated as a private entity not public authority In 2011 the then sports minister Ajay Maken piloted what was called National Sports Development Bill based on the recommendations of Justice Mukul Mudgal Committee The Bill made it categorically clear that only those sports bodies which would agree to come under the purview of the RTI Act would enjoy the right to use ‘India’ as the team’s name — “ In order to represent India at international events and to have a right for a particular sports federation to use ‘India’ or ‘Indian’ in the sport scenario the federation shall have to comply with Chapter IV (Unethical Practices in Sports) and Chapter IX (Applicability of Right to Information Act)” The message of the sports ministry was loud and clear — if the BCCI wanted to continue as the body that was responsible for the selection of the official Indian cricket team for international games then it could not escape the RTI net But then the sports minister’s bold proposal to reform the sports bodies came to a nought when the Manmohan Singh cabinet rejected the Bill The rejection was on expected lines There were several ministers in the Manmohan government who had built deep routes in the BCCI over the decades; they presided over the kitty comprising thousands of crores; they wanted to keep the shenanigans of the BCCI under wraps The leading opposition party the BJP too did not make any hue and cry over the matter as many of its leaders were leading lights of the cricket body as well as other national sports federations The collective might of these politicians with vested interest in sports bodies succeeded in ousting Ajay Maken from the sports portfolio With his ouster the sports bill died a natural death No sports minister thereafter has mustered the courage to revive the bill meticulously drafted by the Mukul Mudgal committee The BCCI’s breather was however short-lived In 2013 Madhu Agarwal an RTI activist sought information from the BCCI regarding some of its policies But the BCCI refused to respond to her request She then moved the Central Information Commission (CIC) for a directive to the BCCI to provide the information On 10 July 2013 the CIC sent notice to the BCCI to appear before it and present its case But the BCCI refused to take cognisance of the CIC notice saying that it did not come under the ambit of the RTI Act and therefore it was not duty-bound to respond to it When CIC threatened to resort to penal provisions owing to the non-response the BCCI moved the Madras High Court to restrain the CIC from proceeding on the matter The high court at Chennai has stayed the CIC proceedings The matter remains sub judice a fact alluded to by the Lodha committee The issue central to the CIC notice and the subsequent stay by the Madras High Court is whether BCCI should be construed as a Public Body The matter had come up before the Supreme Court in 2005 though not in the context of the RTI Act A television network had moved the Supreme Court under the Article 32 of the constitution (direct jurisdiction of the Supreme Court to protect the Fundamental Rights enshrined in the Constitution) to challenge the BCCI’s decision to abrogate the contract for sports coverage The Supreme Court had refused to entertain the case under Article 32 of the Constitution as it said that the BCCI could not be designated as ‘state’ But at the same time the apex court made a significant observation — the BCCI regulates and controls the game of cricket in India to the exclusion of all others; it chooses the national team; It is not just a body undertaking private activity; it is performing public duty Therefore it would come under the writ jurisdiction of the high courts under the Article 226 of the Constitution The Lodha committee report has largely reiterated what the Supreme Court had observed about the BCCI 10 years ago in a different context But the Lodha committee recommendation asking Parliament to enact a law to bring BCCI under the RTI Act is bound to come a cropper given the past experience It would only be possible if the Supreme Court endorses the CIC position and makes BCCI amenable to the RTI Act by a judicial pronouncement The Nobel Prize 2016 for medicine was awarded to Yoshinori Ohsumi of Japan? city nk: How will slums increase Is there even a square foot of land in the city for slums to come up If we search for even 200 square feet of land for a welfare centretoilet in slums or toilet blockswe dont get land I agree that the distance between the slums and the airport is short and it is a security concern We have to secure that and many times I have written to the ATS and police to ensure proper vigil When we want to make a world-class citywe have to ensure that even the slumdwellers are properly rehabilitated Swatee Kher: The Chief Minister made two important decisions regarding slumdwellers and their eligibility before elections this year What is the status on it now Has a new survey been ordered PAP (Project-Affected Persons) get protection till 2000 but the structure is not protected This is causing conflict If the structure is built in 1995 and bought in 2001then they are not eligible There is an injustice to slumdwellers owing to this discrepancy due to our Government Resolution We want to change the GR to ensure that the structure is protected till 2000and even if the person is living nowthey are eligible for the rehabilitation Swatee Kher: Will (it) be applicable for all projects For entire Mumbai Definitelyit has to be applicable for all slums in Mumbai Zeeshan Shaikh: There are complaints that the houses are being divided with internal partitions How will that be handled There can be a way in which this can be worked out The minimum area of a hutmentusually around 10X12 feetis defined and identified Experts and collectors can define this There is some mischievous behaviour Let there be a collector and a MMRDA vigilance committee be formed BMC should not allow new slums to be formed They have been given powers to ensure that illegal structures do not come up P V Iyer: When will the GR be changed One amendment has been madeanother is underway There is a matter in courtso we are treading cautiously The delay is to ensure that there is no contempt We will be able to achieve slum-free Mumbaibring about a change in their standard of living and bring them in mainstream Swatee Kher: The Shiv Sena always says that let all powers be given to the BMCmultiple agencies are making it worse for coordinating and ensuring development of projects That is not true If BMC had fulfilled its responsibilitieswhat would have been the need for MMRDA or MSRDC to step in Government had to bring in its agencies when it saw that the corporation has failed BMC has not been able to supply drinking water to everyone Im not making a political statementthis is a genuine issue now Sharvari Patwa: When BMC is unable to maintain roads it has builtwhat sense does it make for PWD roads to also be transferred to it We are talking about major infrastructure MMRDA or MSRDC are not expected to do small worksfootpaths and bridges Government has brought in these agencies to expedite larger project works because they have the funds There is also pressure on the officials Stuti Shukla: Dont you think it is a bit unfair to say this Most rehabilitation cases of BMC projects are stuck as the collector has not given eligibility certificate For examplethe Mithi project Eligibility of BRIMSTOWAD has to be decided by the government 90 per cent of Mithi is with BMC and remaining is with MMRDA MMRDA has 100 per cent rehabilitationwhat has BMC done Manasi Phadke: Even MMRDA has not completed rehabilitation along Mithi A marginal portion near Mahim is pendingbut they are doing it It will not halt the project From Kranti NagarSaki NagarTungwait is all clear Sharvari Patwa: Why have highways and roads built by MMRDA and PWD being transferred to BMCwhen there are already complaints about potholes on roads PWD was only asked to develop the Eastern and Western Express Highway Not for maintenance Ultimatelythe responsibility of maintenance is with BMC Till the handoverthe responsibility of maintenance is with the agencyafter completion it is with BMCgovernment intervened to provide facilities for Mumbai residents Stuti Shukla: Congress-NCP lost the elections this year despite BMC not doing well What would you have done to change that Yesit was our mistake There was a perception that we have been fighting with an alliance with NCP in state and Parliament We felt that there was a division of votes between us in corporation elections which enabled Sena to win Leaders in both parties felt that we should form an alliance We failed to stay together while contesting the elections Stuti Shukla: What would have been your promise to Mumbaikarswhat facilities would you provide 24-hour water supply to everyone in Mumbai Central government funds have been made available for projects in Mumbai like BRIMSTOWAD These need to be examinedreviewed and implemented at the earliest There is a problem of illegal water connections Why do illegal water connections take placebecause these areas have not been provided with connections BMC should provide the connections to people and the problem would be reduced Zeeshan Shaikh: There were plans to build an Urdu ghar What is its status We had identified land in fishermen colony at Mahimit is a slum area It did not work out We have now asked land from the University campus in Kalinawhere land was given similarly to Sindhi academy SolapurNandedAurangadNagpur we have land Zeeshan Shaikh: What about a branch of Aligarh Muslim Universitythere is opposition for it We have given them consent letter and communicated the site of Kuldabad near Aurangabad There was some opposition from local MP about the University People think that it is a university that only a particular community can access But in realityadmission will be for everyone We were initially looking for land in Malegaon It was hill land and could not be used for the university Land has now been identified in Aurangabad and the project will take off very soon (Translated & transcribed by
