Madurai bench of the Madras High Court while deciding an appeal against a lower court order disallowing the proposed marriage of a minor Muslim girl Prominently reported by ETV Urdu the ruling is likely to be denounced at the Muslim Personal Law Board’s forthcoming meeting in Jaipur Since its inception in 1972 the board has opposed every legislation and judicial precedent which goes against the traditional understanding of Muslim law and in its opinion amounts to “mudakhalat fid-din (interference with religion)” For about nine decades India has been trying to eradicate the evil of child marriage and its ugly consequences In 1926 the eminent social reformer Diwan Bahadur Harbilas Sarda of Ajmer had as member of the Central Legislative Assembly piloted a Hindu child marriage bill The bill’s context was the horrendous problem of infant widows In many Hindu families girls were married in their infancy to male children of tender age Given that the child mortality rate was high many girls would lose their “husbands” and remain “widows” for the rest of their lives because the remarriage of a widow was supposedly prohibited by religion Seventy years earlier Pandit Iswar Chandra Vidyasagar had tried to save the girl child from such a plight by securing the enactment of the Hindu Widows’ Remarriage Act of 1856 But the law went against popular religious belief and didn’t have the desired consequences It was realised that the problem had to be nipped in the bud by the prohibition of the marriage of children male and female Diwan Bahadur took upon himself the task of ensuring there was a minimum age for marriage fixed by law His Hindu child marriage bill was bitterly opposed by the pundits of the time who accused him of singling out their community for “anti-religion” legal reform On the advice of a select committee headed by Sir Moropant Joshi the word “Hindu” was deleted from the bill and when enacted it was to apply to all communities Under Muslim personal law marriage is permitted between a boy and a girl who have attained “bulugh (puberty)” The earliest this could happen is about age 12 and nine respectively and unless attained earlier it is presumed to take place at age 15 for both Notably these age limits are not set by the Quran or Hadith but are mentioned in the books of jurisprudence written in the early years of Islam And yet when the Hindu child marriage bill which was popularly known as the “Sarda bill” was turned into a general law Muslim religious leaders also jumped into the fray to oppose it tooth and nail Overawed by the religious outcry among both Hindus and Muslims most assembly members were reluctant to support it But Diwan Bahadur’s emotionally charged appeal on voting day “I beg you gentlemen to brush aside all objections sacerdotal or profane ancient or modern based on tradition or custom which stint our growth or stand in the way of our achieving our goal” ensured that the Child Marriage Restraint Act of 1929 was passed But the newly introduced law was not accepted by either community The late Justice VR Krishna Iyer had once told me that in 1929 itself there was a child marriage in Diwan Bahadur’s own family In 2006 the 77-year-old act which prescribed mild punishments for those guilty of child marriage was replaced with the new Prohibition of Child Marriage Act The new law prescribes more severe penalties Also every child marriage will remain voidable so that the minor party can get it annulled by a court any time up to two years after attaining majority The law also empowers magistrates to issue injunctions to stop a planned child marriage — in the Madurai case a local magistrate had acted under this statutory provision The parents of the Muslim girl involved challenged the magistrate’s order in the high court claiming that since the 2006 act is repugnant to Muslim religious law it “cannot apply” to Muslims But the bench ruled that the act “crossed all barriers of personal laws” The judicial dictum in the Madurai case is unassailable Many merely permissive provisions of traditional Muslim law including on bigamy and unilateral divorce are unjustifiably seen as scriptural mandates This is the premise of stiff opposition to any reform of Muslim personal law The Constitution which accords religious freedom equally to all citizens protects only essential practices of a religion and not practices that a religion may have merely permitted centuries ago in accordance with the prevailing customs of the time To claim that any professedly heavenly law is supra-constitutional is to live in a fool’s paradise The writer is former chair of the National Commission for Minorities [email protected] For all the latest Opinion News download Taj to Lord’s young nineteen-year-old Deepti Sharma is living a dream At the age of nine Deepti began a journey of which she was uncertain about where it would lead her But with the destination firmly set in her mind she kept following her dream of making it into the women’s cricket team with dogged determination Youngest of seven siblings Deepti was very close to her elder brother Sumit who introduced her to the game of cricket Speaking to Indianexpresscom Deepti recalled the incident which was the changing moment in her life “I used to accompany my brother Sumit to his academy One day I was sitting on the stairs watching his match and suddenly the ball came to me I threw the ball and it directly hit the stumps There were a few girls practising on the field and among them was Hemlata Kala (former Indian cricketer) She asked my brother if I was his younger brother In reply he corrected her and said that she is my sister” Deepti recalls “Without wasting much time Hemlata ma’am asked Sumit to get me for training every day” Deepti credits Kala for her success so far Naturally a right-hander Deepti believes if the former cricketer had not exposed her to the opportunities she wouldn’t have made it into the women’s team at such a young age Fond of watching videos in her free time Deepti is now focused on revamping her spin bowling And to do so she watches Ravichandran Ashwin’s videos and tries to learn from his variations “I haven’t met him yet but am a fan of the variations he uses in Test cricket I often try to bowl the carrom ball at the nets but haven’t used it in a match situation as yet It is necessary to have variations in your bowling as most of the non-Asian players find it tough to handle spin Deepti believes she is more of a batting all-rounder and prefers batting higher up the order However she is comfortable in batting at any position wherever her captain wants her to “The win against England in the (World Cup) opener was a confidence booster for us From there on we started believing in our abilities and complimented each other’s efforts Also we did not rely on one player and saw a different match winner in each game” she said From being 191/3 Indian women’s team was bundled out to 219 Seven wickets in a matter of 28 runs saw India hand the World Cup title which was pretty much in their hands to England “When I went to bat in the final the team needed 28 runs and my focus was on staying until the end I focused on taking singles It was an achievable target but somehow things did not work in our favour” said Deepti when asked about what going on inside her mind during India’s “Not many people recognised us before we went to the World Cup But it is after our performance England that people started hailing us One thing I have learnt is to remain cool in pressure situations Whatever the situation is you need to stay calm which unfortunately we couldn’t in the World Cup” she added When asked about how is Mithali Raj as a captain during intense situations the left-handed batswoman said her captain has qualities similar to that of MS Dhoni “Mithu di is like the Dhoni of our team She is cool and composed at crucial moments She believes our performance should speak for us I always try to learn good things from her” said Deepti Wishing to see more talent step out after their performance at the World Cup Deepti feels women’s IPL should start soon “Women’s IPL should have started long back but its never too late The sooner it starts it’s better for us” she concluded For all the latest Sports News download problem which brought traffic to a standstill last week Manohar Lal Khattar conducting the aerial view Twitter/@mlkhattar Talking to reporters after the survey he said the problem of water-logging at Hero Honda Chowk was an old one and the reason behind it was the shortcomings in planning during construction of National Highway-8 However Gurgaon Municipal Corporation District Administration and Irrigation Department are studying the causes of water-logging which resulted in massive traffic jam on 28 July He also checked the water level of Badshahpur and Najafgarh drains Khattar said the Badshahpur drain has been encroached upon and has not been cleaned properly due to which rain water didn’t drain out The Chief Minister said it was found during the survey that the Najafgarh drain was running up to to its full capacity and water in it was flowing at negligible speed because Delhi Government had constructed a barrage on Najafgarh drain at village Kankrola while no such dam exists in Haryana Thousands of acres of land along the Najafgarh drain in Haryana area was still submerged under water he said He added that this was a big problem for which a big scheme had to be prepared and he would write to the Central Government in this context The construction of flyover became another reason for water-logging at Hero Honda Chowk on NH-8 due to which only three lanes out of the six-lane of the Highway were operational he said Unprecedented heavy rains further worsened the situation and movement of traffic was hindered by large number of ‘Kanwariyas’ and airport taxis who called off their strike at 330 pm that day aggravated the situation he added The Chief Minister acknowledged that traffic could have been regulated in a better manner By: Express News Service | small city-state is inarguably one of postcolonial Asia’s most pivotal figures Under his stewardship Singapore recovered from the scars of a painful divorce from Malaysia in 1965 and was transformed from a fragile nation riven with ethnic conflict into a prosperous city-state Lee’s soft authoritarianism won many admirers most notably in China where Deng Xiaoping had embarked on a similar campaign to marry the economic opportunities afforded by the free market with a political system designed to perpetuate single-party rule Singapore’s economic success and apparent social stability have given rise to loose talk of an “Asian model” that is promoted as an attractive alternative to the untidy and sometimes debilitating challenges of democracy But Singapore’s size — it is a city of a few million people — is an obvious counterpoint to the Singapore fantasy nurtured by many in a larger more diverse country like India Moreover Lee contrived to remain a singular figure seen as incorruptible and pragmatic who was able to keep Singapore’s government unusually clean — something that China’s leaders for instance are unable to emulate Lee himself doubted the existence of an Asian model Instead he spoke of “Asian values” arguing that there were “fundamental differences between Western concepts of society and government and East Asian concepts” But Singapore’s fellow Asian tigers like South Korea and Taiwan which followed the enlightened authoritarianism trajectory transitioned to democracy Singapore itself faces stark questions about how to remain competitive Given its ageing population it is increasingly reliant on immigrant labour to fuel growth which is causing tension with citizens who complain of depressed wages Even in Singapore the durability of the Singapore model is debatable For all the latest Opinion News download Indian Express App More Related NewsWritten by Arushi Jain | New Delhi | Updated: November 18 2016 7:42 pm Bigg Boss 10: Lopamudra Karan
